1. WEBSITE- MERELY A VENUE/PLATFORM
   Web site acts as a mere venue/platform for our members to negotiate/interact for buying, selling and other business services by way of locating companies to trade with, through our on-line exchange.
2. USER(S) ELIGIBILITY
   User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the services provided. Our services are available only to those individuals or companies who can form legally binding contracts under the applicable law. Therefore, user(s) must not be a minor as per Indian Law, i. e. user(s) must be at least 18 years of age to be eligible to use our services.

III. USER(S) AGREEMENT
This agreement applies to user(s) if user(s) are visitors, registered – free or paid user(s) who access the web site for any purpose. It also applies to any legal entity which may be represented by you under actual or apparent authority. User(s) may use this site solely for their own personal or internal purposes.

1. AMENDMENT TO USER(S) AGREEMENT
   IIL may change, modify, amend, or update this agreement from time to time without any prior notification to user(s) and the amended and restated terms and conditions of use shall be effective immediately on posting. If you do not adhere to the changes,you must stop using the service. Your continuous use of the service will signify your acceptance of the changed terms.
2. INTELLECTUAL PROPERTY RIGHTS

VIII. REGISTERED USER(S) 
To become a Registered User(s) there is a proper procedure which is for the convenience of user(s) so that they can easily log-in and log-out.

User(s) can become a Registered User(s) by filling an on-line registration form on the web site by giving desired information (name, contact information, details of its business, etc.). IIL will establish an account (“Account”) for the user(s) upon registration and assign a user alias (“User ID”) and password (“Password”) for log-in access to your Account. Web site does not represent the seller or the buyer in specific transactions and does not charge any commission for enabling any transaction. Web site does not control and is not liable to or responsible for the quality, safety, lawfulness or availability of the products or services offered for sale on the web site or the ability of the suppliers to complete a sale or the ability of buyers to complete a purchase. User(s) are cautioned that there may be risks of dealing with foreign nationals or people acting under false pretenses. Web site uses several techniques to verify the accuracy and authenticity of the information our user(s) provide us.

XII. LIMITATION OF LIABILITY/DISCLAIMER

No warranty or condition expressed or implied or statutory is being provided to the User. Company hereby specifically disclaims any quality, durability, accuracy, reliability and all express or implied warranties including but not limited to warranties of title, merchantability, fitness for a particular purpose or performance. Company does not make any representation or warranties of any kind about any product or Services offered, or displayed or hosted on the Site. All such warranties, representations, conditions and undertakings are hereby excluded.

Under no circumstances shall Company be held liable for any delay or failure or disruption of the content or services delivered through the Site resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control, including without limitation, internet failures, computer, telecommunications or any other equipment failures, electrical power failues, strike, labor disputes, riots, insurrections, civil disturbances, shortage of labor or materials, fires, flood, storms, explosions, acts of God, war, governmental actions, order of domestic or foreign courts or tribunals or non-performance of third parties or other force majeure condition.

The User hereby indemnifies and holds Company harmless against any and all losses, claims, injuries and Damages that may arise out of the User’s breach of this Disclaimer and/or the Agreement, Illegal/Prohibited Content, Warning against Fraud and or any breach of the terms and conditions or the representations or warranties made by the User herein or in the Agreement/usage terms.

Company reserves the right to change the nature of the paid Services offered here or discontinue its Services to a member without any prior notice.

Warning Against Fraud FRAUD WARNING
• All Users are advised to be very careful while doing business with individuals, body corporates or companies from any part of the world.

• Users are advised to exercise due caution while transacting with a prospective buyer or a seller on the Site. Users must undertake interactions or transactions with organizations and/or individuals located on or through the Site, with reasonable caution and after undertaking thorough diligence on such organization and/or individual. Neither the Company nor its director’s, employees, officers or agents shall be liable to any User or otherwise for any illegal or fraudulent interaction or transaction with organizations and/or individuals located on or through the Site.

• Users are advised to not send any advance money/legal fee or products unless there is cash in your account or an irrevocable letter of credit from the buyer, duly authorised by the buyer’s bank.

• Users are advised not to transact business unless full payment is made to you before shipping of the products.

Product Listing Policy

• Free sellers account holders can upload a maximum of 50 products. If you want to upload more than that, please contact the admin at seller@costok.com. Upgrade to your free membership to premium membership to uploading product/service limits. Once the admin approves your request, you can upload unlimited products.
• Sellers are not allowed to enlist used, refurbished, unpacked items on the website. Moreover, sellers are not allowed to list products that are meant for adults only. Your account will be suspended if this is violated.
• The image and the product description should be unique. Only the English language is allowed for product description and product pricing in Indian Rupees only (please mention your product/service price in INR Rupees only). The image should be clear and high quality and they should not have a watermark.
• You are not allowed to sell items that are prohibited by the central government of India and/or prohibited by the state governments or prohibited by any other autonomous authority.
• You are not allowed to list products that are derogatory to any religion or community.
• You can not list arms and weapons. Moreover, you can not list products that aid illegal activities, such as lock picking tools.
• You are not allowed to list products with historical values, artifacts, national treasures or relics of any sort.
• You are not allowed to trade live animals on the website.
• You are not allowed to buy or sell financial instruments including bonds, shares, equity, and others on the website.
• CostOK doesn’t allow buy and sell currency, bank notes, money orders, digital currency and more on the website.
• CostOK strongly forbids the sale of illegal medicines and drugs. Medicines should be allowed for sale in India by the appropriate authority and no recreational drugs, like cocaine or heroine, would be allowed to sell. Your account will be immediately suspended if you are found to offer those products.
• You are not allowed to sell or buy human body organs or remain here.
• You are not allowed to sell badges, identity cards, licenses, visas, permits or other related items.
• CostOK reserves the right to ban or prohibit any other item, from time to time, without prior notice, as deemed fit or to comply with changes in laws and regulations of the land.

Please go through the following terms, conditions, criteria and other important notes. You are allowed to use our services only if you agree to comply the following.

• CostOK (hereafter mentioned as “the company”) functions only as a mediator between the buyers and sellers.
• Sellers can register their account on our website for free.
• The seller must provide his email id, contact number and company name while registering. We might verify any or all of these.
• If you fail to verify any of these information or provide wrong information, the CostOK will not activate your account. The company will not be held responsible for such actions, under any circumstances. CostOK, at its sole discretion, will be the final authority on this.
• The seller either needs to send an email id to the admin from the provided email id or contact the admin via phone or other allowed medium to confirm the information provided. The account will be activated only after the verification.
• The sellers are requested not to share any personal and confidential information with the admin including bank account or debit/credit card number.
• A FREE seller account holder is allowed to enlist only 50 products on the website.
• The seller will not enlist any used, refurbished, defected, or unpacked items on the website. If you are found violating this, the admin, at his sole discretion, will suspend the account. No prior warning will be sent to the seller.
• The seller will not enlist any fake or counterfeit items on the website. If you are found violating this, the admin, at his sole discretion, will suspend the account. No prior warning will be sent to the seller.
• The website will only allow the seller to receive Bulk orders Inquiry. These orders can be checked from the Inquiry/order section of the seller account. The seller needs to check the Inquiry/order from there and confirm the product with the customer.
• The seller can contact the customer and discuss to finalize the payment method for the inquiry/order. The seller is free to accept different payments including prepaid and Cash on Delivery.
• If the seller wants to provide a discount, they can generate coupons from the seller panel. They can generate coupon code for particular products and then share those codes anywhere they want.
• The seller is not allowed to change the product details or delete the product. If they want to change product details including descriptions, price, image, or something else, they need to send such a request to the admin with a justification. Only after that, they will receive the authentication for edit.
• If the seller wishes to list more than 50 products, they need to upgrade their account they need to contact the Sales Team who will change their status to unlimited. This is a paid feature and the sellers are allowed to choose different packages. The payments are to be made to CostOK via check or NEFT only. No cash transaction is allowed. The account will be upgraded after CostOK receives the payment successfully. Select Package
• If the seller can not add products, due to any reason, they can send a list of all the products in an excel sheet to the admin. This sheet should contain all the information about the product. • If the seller doesn’t have Company’s own eCommerce online shopping website, CostOK will create the website for Company this service include in GOLD Package. * Seller Important Nots

• The seller is advised to despatch the product only after receiving payment or assuring cash on delivery or any other mutually agreed mode of payment. If the seller sends the products without confirming the payment, CostOK will not be held responsible for it. The seller will not hold CostOK responsible nor is allowed to blame the admin of anything.
• The seller needs to decide and finalize how to deliver the product to the buyer, including choosing the courier or cargo service and successfully delivering the product. This is the responsibility of the seller alone and the company will not help the seller in this nor does the company provide such services.
• The seller and the buyer are requested not to store any financial details or transactional details on the website. If any damage is done from storing such data on the website, the seller or the buyer would be responsible for that. CostOK will not be held responsible for any such damages nor will compensate the losses in any way.
• The seller is advised to inform the buyer immediately after dispatching the order, informing him or her of the same. Once the product has been successfully delivered, the seller needs to confirm the same from the buyer and need to update the order status as “Order Completed”, in the seller panel. The seller also needs to communicate the same to the admin and the buyer.
